By downloading, installing, accessing, or using the Leveling Steps application ("App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use our App.

3. User Accounts and Registration

Account Creation

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You may have only one account per person

Account Responsibilities

• You are solely responsible for all activities that occur under your account
• You agree to keep your contact information current and accurate

4. Acceptable Use Policy

You may use Leveling Steps for personal, non-commercial fitness tracking and social interaction purposes.

5. User-Generated Content

Your Content

You retain ownership of content you create or share through Leveling Steps, including:

• Comments and messages to other users
• Achievement celebrations and status updates

Content Guidelines

All user content must:

• Be appropriate for all audiences
• Respect the privacy and rights of others
• Be truthful and not misleading

Content Moderation

We reserve the right to:

Leveling Steps and all related trademarks, logos, and intellectual property are owned by us. You may not:

License to Use

We grant you a limited, non-exclusive, non-transferable license to use Leveling Steps for personal purposes, subject to these Terms.

8. Subscription and Payments

Free and Premium Features

• Free Version: Basic step tracking, goal setting, and progress viewing
• Premium Version: Advanced analytics, unlimited goals, premium themes, and exclusive features
• Subscription Model: Premium features are available through monthly or yearly subscriptions
• Feature Access: Premium features are unlocked upon successful subscription purchase

Subscription Terms

• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Billing: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Price Changes: We may change subscription prices with 30 days notice to existing subscribers
• Payment Processing: All payments are processed through Apple App Store or Google Play Store
• Currency: Prices are displayed in your local currency as determined by your app store

Subscription Management

• Cancellation: You can cancel your subscription anytime through your device settings
• iOS Cancellation: Settings > [Your Name] > Subscriptions > Leveling Steps > Cancel
• Android Cancellation: Google Play Store > Menu > Subscriptions > Leveling Steps > Cancel
• Access After Cancellation: You retain access to premium features until the end of the current billing period
• No Refunds: Cancellations take effect at the end of the current period; no refunds for unused time

Refund Policy

• App Store Refunds: All refund requests must be made through Apple App Store or Google Play Store
• Apple Refunds: Contact Apple Support at support.apple.com
• Google Refunds: Contact Google Play Support through your Google Play account
• Our Role: We cannot process refunds directly as all billing is handled by app stores
• Dispute Resolution: For billing disputes, contact your app store's customer support

Free Trial and Promotional Offers

• Free Trials: We may offer free trial periods for premium subscriptions
• Trial Terms: Free trials automatically convert to paid subscriptions unless cancelled
• Cancellation During Trial: Cancel anytime during the trial period to avoid charges
• Promotional Pricing: Special offers and discounts may be available for limited periods
• Offer Validity: Promotional offers are subject to terms and expiration dates

9. App Store Terms and Compliance

App Store Agreements

• Apple App Store: By downloading from the App Store, you agree to Apple's Licensed Application End User License Agreement
• Google Play Store: By downloading from Google Play, you agree to Google Play Terms of Service
• Conflicting Terms: In case of conflict between these Terms and app store terms, app store terms prevail for store-related matters
• Third-Party Terms: You must comply with both our Terms and your app store's terms of service

In-App Purchases and Subscriptions

• Apple App Store: All purchases are processed through Apple's In-App Purchase system
• Google Play: All purchases are processed through Google Play Billing
• Payment Security: All payment information is handled securely by Apple or Google
• Receipt Validation: We validate purchases through official app store APIs
• Regional Availability: Features and pricing may vary by region based on app store policies

App Store Guidelines Compliance

• Content Guidelines: Our app complies with Apple App Store Review Guidelines and Google Play Developer Policy
• Subscription Disclosures: We provide clear subscription terms and auto-renewal information as required
• Privacy Compliance: We follow app store privacy requirements and user data handling policies
• Age Ratings: Our app is rated appropriately for its content and functionality
• Updates and Maintenance: We maintain compliance with app store policies through regular updates

10. Disclaimers and Limitations

Service Availability

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• The App may be temporarily unavailable for maintenance or updates
• Some features may not be available in all regions
• We reserve the right to modify or discontinue features with notice

Limitation of Liability

To the fullest extent permitted by law, Leveling Steps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits.

Subscription and Payment Disclaimers

• Payment Processing: We are not responsible for payment processing failures or delays caused by app stores
• Billing Errors: For billing disputes, you must contact your app store directly
• Subscription Interruptions: We are not liable for temporary loss of premium features due to payment issues
• Price Changes: We reserve the right to change subscription prices with appropriate notice
• Feature Changes: Premium features may be modified or discontinued with notice

11. Indemnification

You agree to indemnify and hold harmless Leveling Steps from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you share through the App

12. Termination

Termination by You

• You may delete your account at any time through the App settings
• Uninstalling the App does not automatically delete your account
• You may request complete data deletion by contacting us

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our community guidelines
• Engage in fraudulent or illegal activities
• Abuse or harass other users
• Attempt to compromise the security of our systems

Effect of Termination

• Upon termination, your right to use the App ends immediately
• Subscription Termination: Active subscriptions are not automatically cancelled upon account termination
• Premium Features: Access to premium features ends immediately upon account termination
• Billing Continuation: You must cancel subscriptions separately through your app store to stop billing
• We may retain some data as required by law or for legitimate business purposes
• Provisions related to intellectual property, disclaimers, and limitations survive termination

13. Updates and Changes

App Updates

• We regularly update Leveling Steps to add features and fix issues
• Some updates may be required for continued service
• New features may be added or existing features may be modified
• We recommend keeping the App updated to the latest version

Terms Updates

• We may update these Terms from time to time
• Material changes will be communicated through the App or email
• Continued use after changes constitutes acceptance of new Terms
• If you don't agree to changes, you should stop using the App

14. Governing Law and Disputes
